Overview

Working with (and Winning) Texas Workers' Compensation Non-Subscriber Claims With limited exceptions, every state mandates that businesses provide workers' compensation coverage to their employees. Well, all except for one: Texas. Texas is unique in that businesses do not have to opt in to the state's workers' compensation program. While this sounds like it could be an easy way for businesses to avoid liability for the on-the-job injuries of their employees, it is actually the opposite. Becoming familiar with the ins and outs of workers' compensation non-subscriber claims is an important addition to an attorney's toolbelt when practicing in Texas.

This program, taught by attorney Mac Phelps, will review Texas' unique workers' compensation system; outline the benefits and drawbacks of non-subscriber claims; and teach tools and tips to attorneys navigating non-subscriber claims on behalf of their clients. The program is aimed at attorneys advocating on behalf of plaintiffs, but it can also be of use to defense counsel advising employers on risk exposure in a lawsuit or in-house counsel assisting in choosing insurance coverage for their company.

Learning Objectives:

  1. Break down the Texas Workers' Compensation system as outlined in the Texas Labor Code

  2. Explore the rights an employee has when filing a workers' compensation non-subscriber claim

  3. Examine the effects of arbitration agreements, occupational health plans, and other similar frameworks on an employee's non-subscriber claim

  4. Identify tactics to apply pre-suit and after filing suit to effectively resolve non-subscriber claims efficiently
