Overview
Lawyers are often the first to notice when a colleague is struggling with substance use, mental health issues, or behavioral changes that could compromise professional responsibilities. But knowing what to do-and how to act ethically and effectively-can be incredibly challenging. In this timely and compassionate program, attorney Brian Quinn explores the ethical, emotional, and professional complexities lawyers face when a colleague's impairment becomes apparent.
Through real-world examples and a breakdown of model rules, attendees will learn how to recognize signs of distress, distinguish between stress and impairment, and take steps to intervene while protecting client interests and maintaining professional obligations. This session also introduces motivational and collaborative intervention techniques tailored to legal professionals and reviews the role of Lawyer Assistance Programs (LAPs) as a confidential, non-disciplinary support resource.
Learning Objectives:
- Recognize the warning signs of substance use disorders, depression, stress, and other forms of impairment common in the legal profession
- Distinguish between normal occupational stress and distress that impairs professional performance
- Apply ethical rules related to supervisory responsibilities and reporting under the Model Rules of Professional Conduct, including Rules 8.3 and 5.1
- Evaluate appropriate intervention strategies, including how and when to approach a colleague using motivational, non-confrontational methods
- Utilize Lawyer Assistance Programs (LAPs) as confidential, supportive resources for intervention planning, treatment referral, and ongoing peer support
