Overview

The landlord-tenant relationship is a complex one which is often the subject of disputes and litigation. When such problems arise, an assessment of the rights and obligations of the parties – and, ultimately, the solutions to these problems - must take into consideration the requirements established through the governing lease, all applicable landlord-tenant statutes, and controlling case law. In addition, in order to fully assess the best strategies, options, and next steps, lawyers must have a clear understanding not only of these requirements, but also of the facts surrounding the particular issues in dispute as well as the procedures for addressing these issues in the courts. Moreover, depending on the type of dispute, the ultimate resolution may also be affected by related laws pertaining to real estate, to creditor’s rights, and to bankruptcy.

John Ivins, a partner with the law firm of Hirschler Fleischer who has practiced in this area for more than 20 years, will explore the complexities of the landlord-tenant relationship. In addition to addressing the legal requirements established by the lease and the applicable law, John will discuss strategies for improved landlord-tenant relationships and for solving landlord-tenant disputes. He will also review recent cases and changes in the laws pertaining to the landlord-tenant relationship in Virginia.
