Course Description

This course, presented by Hogan Lovells International Trade practice Partner Bob Kyle and Counsel Brian Curran, examines export control rules and considerations relating to Unmanned Aircraft Systems (UAS).  The course reviews all dimensions a company needs to know in this area, including how to determine whether export control rules apply to their activities, how to identify the impact that any applicable export control rules might have on a business, how to secure the necessary licenses and approvals, and how to establish a compliance program.

Robert D. Kyle

Hogan Lovells

Robert Kyle has nearly 20 years of experience in international trade law and related issues as well as extensive experience in senior positions at both the White House and U.S. Congress. 

 

Robert rejoined Hogan & Hartson from his position as a senior administration official at the White House, having served as Associate Director for National Security and International Affairs at the Office of Management and Budget. In this position, he focused on policy, budgetary and congressional strategy decisions involving defense, foreign affairs and international economic issues. He was responsible for virtually all international functions of the U.S. government, managing a $300 billion budget.

 

Previously, Robert served at the National Security Council and the National and Economic Council as Special Assistant to the President for International Trade and Finance. In that capacity, he had significant responsibility over virtually all international trade issues facing the U.S. government.

 

Before his tenure at the White House, Robert was the Chief International Trade Counsel to the U.S. Senate Committee on Finance, the Senate committee with primary jurisdiction over trade matters. Prior to his tenure with Congress, he was associated with a leading investment banking firm.

Brian P. Curran

Hogan Lovells

Brian Curran advises clients on international trade compliance matters, including those involving the Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR), and economic sanctions programs administered by the Treasury Department’s Office of Foreign Assets Control (OFAC). Brian also has extensive experience advising clients on national security reviews conducted by the Committee on Foreign Investment in the United States (CFIUS). Prior to joining Hogan Lovells, Brian served for 10 years as an analyst with the Defense Intelligence Agency, where he held a TS/SCI clearance.

 

Brian provides clients with advice and representation before CFIUS and the U.S. Departments of State, Treasury, and Commerce. Brian's representative matters include:

Successfully obtaining CFIUS clearance for the largest proposed Chinese acquisition of a U.S. company at the time

Representing JX Nippon Oil & Gas Exploration Corporation before CFIUS in connection with a carbon capture and CO2-enhanced oil recovery project

Advising universities and Internet and software companies on the export control implications of cyber attacks and cloud computing

Conducting for a U.S. electronics company a complex multi-jurisdictional internal investigation involving alleged trade compliance violations

Representing U.S. and foreign companies in enforcement actions related to U.S. export control and economic sanctions laws

Analyzing the implications of Export Control Reform on a U.S. defense contractor

Advising U.S. and foreign satellite companies on ITAR and EAR enforcement and licensing matters

Conducting in-depth trade compliance audits for a major U.S. defense contractor

Performing buyer- and seller-side trade compliance due diligence in connection with cross-border mergers and acquisitions

 

Following graduation from law school, Brian served as a law clerk to The Honorable Charles F. Lettow of the United States Court of Federal Claims.
