We have all heard substance abuse presentations that give you statistics and facts about lawyers who drink. But what about those in the legal system who must deal with the substance-impaired attorney who does not voluntarily seek nor feel compelled to get help? What should an attorney do if he reasonably believes that opposing counsel’s handling of litigation or a deal is affected by problems with substance abuse? What is the client’s role in addressing such a situation? What can or should a judge do when faced with a lawyer whom she believes is impaired on the day trial is set to start? However, as impairment can also be the product of mental illness (which strikes people of all ages, genders, and professions) this program also discusses how mental illness can compromise the ability to render legal services competently. It provides tips to recognizing symptomology of mental illness and substance, dealing with them in the practice of law and various methods of prevention.
