Special Monthly Compensation (SMC): Veterans Affairs (VA) Disability Law

Overview

Established by statute, Special Monthly Compensation (SMC) is a monthly benefit paid to service-connected veterans in addition to basic compensation rates. Unlike the standard VA Schedule for Rating Disabilities, which is based on the average loss of earning capacity, SMC is designed to compensate for non-economic losses, such as the loss of use of a hand, foot, or vision.

This course provides a focused discussion on the applicable statutes and VA regulations governing these specialized benefits. Through a series of hypothetical exercises, participants will apply the regulations to specific fact patterns to better understand SMC eligibility. Attendees will gain the practical knowledge necessary to identify when a veteran qualifies for SMC and how to effectively explain these complex benefit tiers to their clients.

Learning Objectives:

  1. Identify the specific circumstances and qualifying disabilities under which Special Monthly Compensation (SMC) is applicable

  1. Analyze the applicable SMC statutes and VA regulations to determine accurate benefit eligibility

  1. Apply VA regulations to complex fact patterns through the use of hypothetical exercises

  1. Communicate effectively with veteran clients to explain the mechanics, purpose, and requirements of the SMC system
