Overview
Foreclosure defense is about economics more than it is law, because the plaintiffs’ firms get the same flat fee per file whether the files are contested or not. For this reason, this course will begin with a discussion of the client’s final plans which in turn affect your tactical approach to dealing with the rigid, other side.
Next, the course will discuss the various segments of a successful representation including motion work, pleadings, standings, SEC filings and Discovery, which if carefully considered and thoughtfully grasped by the attorney can comprise the elements of a victory for you and more importantly, your client.

II. Properly steer your representation to achieve the aforementioned goal
III. File motions to dismiss and/or strike a complaint.
IV. Approach pleadings with an understanding of the factors in play and how they may be manipulated
V. Identify and conquer issues of standing, reviewing the ‘securitized trust issue’
VI. Prepare and employ a careful, effective, efficient discovery strategy
