Overview

Receiving tax-exempt status under Code Section 501(c)(3) is an important piece in beginning operations as a charity. With that IRS determination, however, there is another classification that can impact ongoing operations. Is the organization a private foundation or public charity? This program, taught by Anita Pelletier of Nixon Peabody's nonprofit practice group, will discuss these different classifications, including the rules and restrictions that apply to the private foundation; different types of public charities; and key considerations for ongoing compliance. Attendees will come away with a practical understanding of these classifications and how they can impact the ongoing operations of a charity.

Learning Objectives:

  1. Explore the provisions under the Internal Revenue Code relating to a private foundation and public charity classifications

  2. Discuss how to calculate the mathematical public charity tests.

  3. Identify challenges to ongoing qualification as a public charity
