Overview

This course will explore how Generative AI presents both opportunities and ethical challenges in the practice of law.

We will examine the key ABA Model Rules and principles outlined in the recently released ABA Formal Ethics Opinion 512, with special attention given to the responsibility of supervisory lawyers and best practices for using GAI tools in a way that maintains ethical compliance. 

By the end of the course, attendees will understand the ABA guidance on the use of GAI and have a strong framework for making informed decisions about when and how to responsibly incorporate GAI into their practice.


Learning Objectives: 

  1. Review the ethical implications of integrating Generative AI (GAI) into your legal practice, focusing on maintaining compliance with the eight (8) Model Rules most relevant to its use
  2. Identify the potential ethics traps under our duties of client confidentiality, competence, and conflicts of interest when using GAI tools and discuss what is required to address them given the recent ABA guidance
  3. Explore how the duties of candor, communication, and informed consent apply to the use of GAI in law
  4. Discuss why it is important to develop best practices for ethically managing the use of GAI in law firms, including the training and supervision of attorneys and non-attorney staff
