Overview

Employers with collective bargaining agreements that include contribution obligations to a multiemployer pension plan are generally not involved with plan administration beyond providing census information (hire dates, termination dates, etc.) and remitting contributions. However, employers may not be aware of their ongoing exposure to withdrawal liability, the potential amount involved, or their rights under ERISA.

This program, presented by Paul Porretta of Troutman Pepper Hamilton Sanders LLP, will cover:

  • Background on the formation and operation of multiemployer pension plans

  • The types of withdrawal liability and events triggering a withdrawal

  • Withdrawal liability calculation methodology

  • Certain industry exceptions to withdrawal liability and special rules

  • Payment of withdrawal liability; and

  • Dispute resolution procedures

Learning Objectives:
  1. Advise on withdrawal liability risk
  2. Monitor potential withdrawal liability
  3. Respond to a notice of withdrawal liability
