Overview
This program will explain common marketing strategies and provide an overview of common marketing law issues. We will discuss a wide array of marketing law concerns such as implied claims, claim substantiation, comparative claims, disclosures, social media enforcements, and pricing claims. There will also be a brief overview of the common ways marketing law intersects with trademark law, copyright law, publicity right licensing, and data privacy law.
This program will benefit attorneys who need to keep their own marketing compliant, as well as attorneys who advise business clients on marketing strategies.

Identify modern-day marketing strategies
Discuss common pitfalls of implied claims and express claims
Explain the basic legal requirements for claim substantiation
Analyze comparative claims (e.g. #1 claims)
Examine common advertising disclosure requirements
Discuss social media endorsement guidance
Review risks of "free" claims and "up to" claims
