Overview

Estate planning for the LGBTQ community became significantly less challenging when the  Supreme Court, with rulings such as U.S. v. Windsor and Obergefell v.Hodges, seemed to solidify marriage equality and family rights for LGBTQ couples. However, what has now transpired in light of the current Supreme Court composition, rulings, and laws of Southern  States that have embraced this turn away from equality is critical to understand. As discussed before, several factors are involved in most legal struggles for equality: generally, the public must be in favor of or ambivalent to the issue; the public must also have a majority of legislators willing to bring the issues before their colleagues for a vote; or the Supreme Court must have a majority that is either reasonably in favor of the law or contains one or more majority members willing to provide a plurality vote.

This program, presented by Max Elliott, founder of a Chicago-based firm practicing estate planning and wealth preservation for the LGBTQ community, women, and small business owners, will engage in a high-level discussion of the current landscape of critical estate planning issues for the LGBTQ community, and the implications on those issues by current SCOTUS  decisions.

Learning Objectives:

  1. Analyze the jurisprudence of the United States Supreme Court and how its composition  has affected equality issues for the LGBTQ community
  2. Identify the confluence of laws, beginning with SCOTUS and flowing through to administrative and state agencies, that affect LGBTQ family equality
  3. Discuss intersecting estate planning and family law issues, such as reproductive rights and trans rights, affecting LGBTQ families
  4. Break down the use of appropriate estate planning techniques to protect LGBTQ families, including choice  of law provisions
