Overview
You probably know the basics of the Family and Medical Leave Act (FMLA) and the Americans With Disabilities Act (ADA), but how do these laws work in practice? Perhaps your company has outsourced its leave administration, but you've since realized there are still implementation challenges for which Human Resources is responsible. This program provides practical guidance for navigating the complex intersection of leave laws and workplace accommodations that continue to challenge employers. Because leave and accommodation issues are some of the top areas of concern (and litigation) for organizations, we will also consider throughout how to mitigate risks of claims.
Marc Scheiner of Duane Morris LLP, will provide insight and guidance as we work through common (and often complicated) scenarios that frequently lead to compliance challenges. We'll consider how the FMLA and ADA overlap and differ, how they interact with other types of leave and how to navigate common issues that arise. This intermediate-level course is designed for HR professionals, in-house counsel, and anyone who wants to learn more about Leaves and Accommodation issues.
Learning Objectives:
- Apply knowledge of FMLA and ADA to complex workplace scenarios where these laws intersect with other leave entitlements and other employment-related concerns
- Navigate the interactive accommodation process, including proper documentation and analysis of reasonable accommodation requests
- Analyze common compliance pitfalls in leave administration through examination of real-world scenarios, with particular focus on situations that frequently lead to litigation
