Overview

You probably have an idea by now of the basics of the Family and Medical Leave Act (FMLA) and the Americans With Disabilities Act (ADA). But how do these Acts work in practice? Maybe your company has outsourced its leave administration, but you've since realized Human Resources still has a role to play in the process. Or, perhaps, you just want a refresher on Leaves and Accommodation issues.  They are, after all, some of the top areas of concern (and litigation) for organizations of all kinds.

In this training, presented by Marc Scheiner of Duane Morris, we'll dig-in further to how the FMLA and ADA show up in workplaces, providing challenges for HR departments and managers. We'll consider how they overlap and differ, how they interact with other types of leave and benefits and how to navigate common issues that arise. Together, we'll explore how accommodation issues intersect with other HR areas, including the hiring process and performance management, to get a more robust picture of how it all works together.

This intermediate-level course is designed for HR professionals, in-house counsel, and anyone who wants to learn more about Leaves and Accommodation issues.

Learning Objectives:

  1. Review legal background of the FMLA and ADA

  2. Understand common (and often complicated) ways that these Acts show up in the workplace, through analysis of real-world hypotheticals

  3. Develop further insight into the ADA's interactive process

  4. Consider non-legal issues and business risks related to accommodations

  5. Appreciate how to leave and accommodation issues arise in different areas, focused on the interviewing/hiring process and the performance management
