Overview
This program will begin with a review of issues that arise for lawyers in a professional environment that is increasingly virtual and mobile, including data breaches, working remotely, and the impact of generative AI. The focus will be on recent developments and emerging requirements. The second part of the program will examine developments in conflicts as they are impacted by the changing dynamics of corporate relationships and the fluidity of lawyers' relationships among themselves. The discussion will identify some potential red flags and practical considerations. This program should benefit experienced attorneys in private practices of virtually all sizes and scope and should also be of interest to in-house attorneys.
Learning Objectives:
- Identify emerging trends and approaches to remote practice and the limits on true multijurisdictional practice
- Analyze, avoid, and prepare for data breaches and other potential breaches of ethics duties (and possible malpractice) emanating from the necessary use of technology
- Provide early warnings about pitfalls of uncritical reliance on AI
- Break down trends and significant new case law developments involving sources of attorney conflict and their consequences
- Flag emerging conflict issues and tensions between lawyer's independence and client guidelines or expectations
