Overview
Judgment enforcement is a critical area of civil practice, which gives weight and force to litigation. Despite the potential consequences of failing to comply with a judgment (including the payment of additional interest and costs), many defendants refuse to pay following the entry of a judgment against them. As a consequence, plaintiffs are often forced to pursue payment long after judgment entry, and must be persistent and creative to obtain satisfaction. This course explores the procedure and mechanisms available to aggrieved parties to enforce and satisfy judgments under New York law.
Learning Objectives:
I. Learn the mechanisms for obtaining a judgment
II. Understand the preparation and submission of judgments
III. Become familiar with post-judgment discovery and enforcement devices
IV. Identify the procedure for levying money and property
V. Recognize the methods for amending a judgment
VI. Summarize practice and procedure following the satisfaction of a judgment
