Estate planning lawyers typically focus on helping “boomers” (and well beyond) pass legacies of accumulated wealth to the next generation in a tax advantaged and so-called “creditor/predator” protected way. Yet upon reflection, isn’t it perhaps the young family that truly needs the protection and peace of mind that a thoughtful and robust estate plan brings?
When asked whether they need a Will, virtually every young mom and dad emphatically says “yes.” So then why don’t they have them? And what about planning for disability - shouldn’t everyone have a Durable Power of Attorney and a Living Will/Health Care Proxy, just in case?
