Overview
On January 13, 2022, the U.S. Supreme Court issued a decision on the matter of OSHA's Emergency Temporary Standard ("ETS") and reinstated the injunction on implementing and enforcing the ETS, finding OSHA exceeded its authority in implementing the ETS, and that challengers of the ETS were likely to succeed on the merits of their claims. It is important to note, however, that the Court's Order is not a final determination. When examining the effects that vaccine mandates have had on the US workforce, the turbulent landscape makes it difficult to determine where exactly we will end up across local, state, and national levels.
