Overview
This program, taught by Michael Lynch and Brenda Fulmer, veteran plaintiff-side mass tort litigators and consumer advocates, will feature an introduction to Multi-District Litigation (MDL) and state-coordinated proceedings for pharmaceutical and medical device mass torts. The presenters will review the legal basis and requirements for MDL formation, provide an overview of the Judicial Panel on Multidistrict Litigation (JPML) process, discuss best practices in leadership establishment and other roles, as well as strategies for preservation orders and discovery. The course will also address specific case studies in-depth, identifying lessons for practitioners.
Course Objectives:
- Apply for and argue an MDL application with the JPML
- Establish a role for each firm after MDL formation
- Analyze lessons from past mass torts MDL litigation
