Overview

Environmental issues affect nearly all types of law practices including real estate, banking, municipal law, construction, corporate transactions, employment, litigation, and others. This program is designed to provide a foundation in environmental law to attorneys who do not typically practice in this area. 

The program will cover emerging environmental laws and claim trends, and their impact on corporate and real estate transactions and an operating business. It will discuss risk management strategies, including indemnification and additional insured status specific to environmental claims, and appropriate environmental insurance solutions. In particular, the program will provide practical tips for lawyers, such as (1) the right amount of environmental due diligence for a banking or real estate transaction; (2) environmental risk management considerations; (3) the use of insurance products to protect against environmental risk; and 4) maximizing cost recovery for claim exposures include losses from mold, legionella, asbestos, new regulated contaminants, virus and other biologics. Viewers will be provided with summary sheets and articles to assist in summarizing the risks and environmental insurance coverage solutions.  

Finally, the program will review hypothetical real estate transactions and corporate acquisitions in which both environmental and representations & warranties insurance are evaluated. The course will benefit any attorneys looking to impress clients or lenders with their understanding of environmental laws, exposures, avoidance of claims, and risk management and insurance solutions.
