Course Description

Trade secrets are one of the company’s most important intellectual property assets. Trade secrets is a vast term, encompassing business assets such as customer information, pricing, business and marketing plans, to technical trade secrets like formulas, manufacturing processes, and R&D information (to name just a few). Of course, as the name suggests, the key feature of a trade secret is that it is kept secret. This can always be a challenge for any business, but it has been specially tested during COVID-19. So many companies are experiencing new ways of working - including remote work, pivoting to meet market demands, launching new products and services, redeploying workers in different positions, and more. Add in the enforcement difficulties brought by widespread court closures and slowdowns, among other things, and the challenges mount. 

This interactive panel of in-house counsel, led by Nicole Galli, William E. Mosley,  Jennifer Miller, and Andrea Castetter will discuss the challenges (and possibly even opportunities) they face on a daily basis in protecting this key asset.

Nicole D. Galli focuses her practice on commercial litigation, including all forms of intellectual property (IP) litigation, and IP counseling, especially regarding trade secret protection. Nicole has litigated a wide variety of IP and business disputes for clients in federal and state courts, administrative forums, and arbitration and mediation venues throughout the nation. She represents clients in patent infringement and licensing litigation, trademark matters including infringement, as well as opposition and cancellation before the U.S. Trademark Trial and Appeal Board, trade dress infringement, copyright infringement and misappropriation of trade secrets. Nicole is a frequent speaker, author and thought leader on various legal topics including intellectual property strategy, trade secrets protection and litigation, trademark, copyright and patent law and litigation, commercial litigation best practices and procedural matters, and litigation financing. For years she has been recognized as a Pennsylvania Super Lawyer for Intellectual Property Litigation and an AV-rated attorney by Martindale Hubbell. This past year, Nicole was named one of the Philadelphia Business Journal’s Women of Distinction which spotlights the region's most influential business women and one of The Philadelphia Inquirer’s Influencers of Law for her work in IP Litigation.

Nicole received her B.A from the University of Pennsylvania, where she graduated cum laude, and received her J.D from University of Pennsylvania Law School.  She is admitted to practice in Pennsylvania, New Jersey, New York and Delaware (inactive), and numerous federal courts.

Jennifer Miller

Jenny Miller is the CLO, SVP and Secretary for Renmatix – a plant-based platform technology company making upcycled and sustainable products for a variety of markets including food and beauty.  She works closely with Renmatix technical and commercial teams to advise and advance the strategy and success of Renmatix.  She is responsible for the company’s intellectual property strategy, and oversees the prosecution and maintenance of its robust and growing portfolio of patents and trade secrets.  She plays an important role in collaboration, financing, and acquisition transactions.  She works closely with the CEO and with the Board of Directors.  She is also responsible for the company’s human resources.  Before Renmatix, Jenny was a partner of Ballard Spahr LLP in the Business and Finance Department, with clients that included entrepreneurs, emerging technology developers, global conglomerates, venture capitalists, universities, and more.

William E. Mosley

Applied Materials

Will Mosley is Senior Counsel in the Global Litigation & Investigations team at Applied Materials. In this role, he is responsible for managing and conducting offensive and defensive investigations, litigation, and pre-litigation matters worldwide, with an emphasis on the protection of Applied’s intellectual property.  Will currently oversees a variety of litigation matters concerning trade secrets, general commercial disputes, and tort matters in the U.S. and overseas.

Prior to joining Applied, Will was a patent litigator at a large international law firm, where he also engaged in trade secret litigation, general commercial litigation, and served as outside IP enforcement and licensing counsel to one of Silicon Valley’s pre-eminent technology companies.

Andrea Castetter

Andrea Castetter is

Chief Operating Officer - Legal and Information and Digital Solutions (Information Technology, Advanced Analytics and Data Sciences, and Information Security), Cyber Security, Privacy, and Trade Secret Counsel for Eli Lilly and Company. She is also currently the Lead Information Counsel at Lilly managing Information Technology, Information Security, Cyber Security, Privacy, and Trade Secrets. Her practice has included many aspects of patent law, including procurement, transactional, licensing, and litigation. Andrea has extensive experience in cybersecurity, data protection, and security, and trade secret law, including internal investigations and complex litigation matters. She has a B.S. in Chemistry and worked for Lilly for 8 years as a scientist prior to her legal roles.
