Overview

This presentation is an introductory course to the major topics and issues that arise in family/matrimonial practice, and the New Jersey rules governing these legal issues. Family law covers all issues arising out of a marriage relationship, dating relationship, co-parenting relationship, and cohabitating relationship. This course, presented by Angelica Mercado and James DeStefano, will cover a broad spectrum of legal issues, procedural and substantive rules/laws, and best practices for managing family law cases. This course is ideal for the newly admitted attorney or law clerk or any practitioner wanting to understand the nuts and bolts of family practice.


Learning Objectives:

  1. Identify key issues in the practice of family law

  2. Develop familiarity with the procedural requirements of litigating in the family courts

  3. Review the basics of matrimonial, non-dissolution, and domestic violence matters and the substantive rules governing these cases

  4. Strategize best practices for managing cases and counseling clients in family law matters

James DeStefano

James M. DeStefano is Counsel at Einhorn, Barbarito, Frost & Botwinick and serves clients in the firm’s matrimonial and family law department. 

James graduated cum laude from New York Law School in 2010.  After graduation, James served as law clerk to the Honorable Robert J. Gilson (Sussex County Superior Court, Chancery Division, Family Part).   He joined Einhorn Barbarito in September 2011.  James’ practice is devoted to family law, where he specializes in handling high net worth divorce matters and prenuptial agreements.      

James is a volunteer Early Settlement Panelist for Essex County and Morris County.  James is a Trustee of the Morris County Bar Association.  James has also been recognized several times by Thomson, Reuters, Super Lawyers as a Rising Star.

Angelica M. Mercado is an Associate with Einhorn Barbarito and a member of the firm’s Family/Matrimonial Law practice. Prior to joining the firm, Angelica served as a law clerk for the Honorable John P. McDonald, J.S.C., and the Honorable John W. Romankow, J.S.C. in the New Jersey Superior Court’s Family Part in Somerset County.

While completing her Juris Doctor at Seton Hall University, she also completed her master’s degree in diplomacy and international relations. As a Center for Social Justice Scholar at Seton Hall University School of Law, she worked with various public interest initiatives including the Immigration and International Human Rights Clinic, the Equal Justice-Civil Rights Clinic and the New Jersey Detention and Deportation Defense Initiative. A fluent Spanish speaker, Angelica has significant experience working with clients from different backgrounds, and her experience provides her with a unique perspective on the intersectional issues that arise in her practice.

Angelica currently serves as a Trustee-at-Large on the board of the Hispanic Bar Association of New Jersey and as a Non-Voting At-Large Member of the New Jersey State Bar Association-Young Lawyers Division Executive Committee.
