Overview
This session, presented by certified elder law attorney Howard Krooks, will cover some of the legal rules applicable to attorneys working with clients who experience diminished capacity and the consequent potential for fraud and abuse against a client with diminished capacity. In this course, attendees will learn how to identify a client who has diminished capacity and the appropriate steps to take to assure continuity in managing the client's portfolio. The course will also discuss how to document a client's file with the appropriate legal documents to anticipate diminished capacity protocols and practices the advisor can use to protect him/herself.
