Overview
As the United States population ages, attorneys are challenged and charged with the task of ensuring that our clients come to us and retain us under no undue influence. With increasing instances of elder abuse by family members, aides, fiduciaries and strangers, there is increasing difficulty in determining where this ethical fine line is drawn. This program, presented by elder law attorney Lenore Davis, will explore ethical considerations in elder law using The Giving Tree as a paradigm.
Learning Objectives:
- Gain a sensitivity to issues of elder abuse in clients
- Identify what parties are commonly tied to instances of elder abuse and use of undue influence
- Examine the ethical considerations an attorney should consider when dealing with a client who is under undue influence
