Overview

This CLE is designed to enhance your probate and estate planning knowledge base in regards to digital assets. We are going to learn what a digital asset is, and the various ways individuals can own and custody digital assets. We will discuss the current pain points that  exist, and the present-day methodology in place, when probating digital assets through a decedent(s)'s estate. Finally, we will discuss the growing trend of incorporating digital assets into an estate plan. This program will benefit practitioners who are primarily probate attorneys and estate planners by trade, especially as digital asset ownership is on the rise.

  1. Identify the various types of digital assets 
  2. Break down the ways a digital asset can be owned, stored, and custodied by a client
  3. Recognize the current procedures in place to probate digital assets through a  decedent's estate 
  4. Distinguish the current techniques to plan for digital assets in an estate plan, specifically probate-avoidant plans 
  5. Realize that digital assets are an emergent asset class, with many aspects of our current estate planning techniques potentially evolving rapidly in the near future
