Overview

Digital assets -- whether in the form of cryptocurrencies, stablecoins, NFTs, or other decentralized finance products -- have grown exponentially in recent years, frequently topping national headlines and surpassing $2 trillion in total market capitalization. Yet in the United States, significant uncertainty remains about precisely how and when digital assets are regulated and which federal agencies will take the lead in promulgating new guidance, commencing relevant investigations, or, in some instances, bringing enforcement actions. Government leaders in Congress, the SEC, CFTC, Treasury, and Federal Reserve have increasingly weighed in on this evolving and increasingly consequential asset class.

Ashley Ebersole, Lindsay Lin, and JP Schnapper-Casters bring a unique interdisciplinary perspective to this pressing set of legal and policy issues and will analyze recent developments and likely trends in the digital asset space. This program is intended to primarily benefit technology lawyers, in-house counsel, and investors in the digital asset sector.

Learning Objectives:

  1. Identify key regulators as well as central principles for securities compliance

  2. Examine frequent questions and concerns from an investor perspective

  3. Survey other regulatory trends and risks for 2022 and beyond
