Course Description

This course, presented by Delphine O’Rourke of Duane Morris LLP, will cover the key legal issues that health care providers along the continuum of care should consider in developing both their short and long term responses and recoveries from the COVID-19 pandemic. The program will cover President Trump’s March 13th Declaration of a National Emergency and its impact on providers, waivers of certain CMS conditions of participation, Section 1335 Waivers, EMTALA guidance for COVID-19 patients, supply change management, and the impact of shifts in physician allocation on physician arrangements. As the regulatory environment is fluid, there may be additional topics added to the presentation.

Learning Objectives:

  1. Examine what President Trump’s national declaration emergency means for healthcare providers

  2. Review the current regulatory landscape, including waivers of certain CMS conditions of participation, Section 1335 Waivers, and EMTALA guidance for COVID-19 patients

  3. Survey the fast-moving changes surrounding physician allocation

  4. Identify how these key developments impact short and long term response planning for healthcare providers
