Overview

The Condominium and Cooperative Protection and Abuse Act is a lesser known and often misunderstood federal statute. But hidden within it are potent statutory rights enabling condominiums and cooperatives to recapture valuable building amenities that are under long-term, unfavorable leases with their developers. These rights remain alive and relevant today - even condominiums and cooperatives created during the 1980s conversion boom may still capitalize from its provisions.

This program, taught by two experienced New York commercial and real estate practitioners, will benefit attorneys who serve as counsel to cooperatives, condominiums, developers, or even commercial tenants in a condominium or cooperative building.

Learning Objectives:

  1. Examine the purpose and powers of the Abuse Act
  2. Gain an understanding of its application and the areas that may be exploited
  3. Discuss how litigation has shaped the Act and how recent cases may offer new hope
