Overview

With the enactment of the first comprehensive federal crypto laws in 2025, attorneys advising financial institutions, technology companies, and investors face a shifting legal and regulatory environment. This program will examine the GENIUS Act, the Digital Asset Market Clarity Act, and related regulatory developments, focusing on how these laws alter the treatment of stablecoins, decentralized finance, and tokenized assets.

Through analysis of new statutes, agency rulemakings, and emerging case law, participants will learn how to advise clients on compliance obligations, manage regulatory risk, and anticipate potential enforcement actions. The program will also address exchange-traded crypto products, NFTs, and tokenization of real assets, providing practical guidance for navigating this complex and fast-moving area of law.

Learning Objectives:

  1. Analyze the GENIUS Act and Digital Asset Market Clarity Act to advise clients on the regulatory status of stablecoins, DeFi platforms, and digital asset transactions
  2. Interpret guidance and rulemakings from the SEC, CFTC, OCC, and other regulators to identify compliance risks for financial institutions and technology companies
  3. Apply requirements to client matters involving crypto exchanges, custodians, and tokenized asset offerings
  4. Develop strategies to mitigate enforcement and litigation risks while supporting innovation in digital assets and emerging financial technologies
