Overview
William Blackstone, the leading and most influential expositor of the English common law in the 18th century, described self-defense as the "primary law of nature." Cultures the world over and across the centuries have likewise acknowledged the right of self-defense. Why then do so many Americans today, including attorneys, fail to understand the laws and key concepts behind self-defense, particularly that of deadly force in defense of self or others? In this class, we will look at some recent, well-publicized cases and cover some of the key legal concepts behind the right to self-defense in this country.
Ms. Gervase will discuss:
The use of less-lethal force v. deadly force and their justifications
Self-defense inside the home v. outside the home, including the concepts of Castle Doctrine and Stand Your Ground laws
Defense of others and defense of property
The most common errors those who claim self-defense make
How to advise clients on self-defense both before and after an incident occurs
Tips on training and insurance that can help
