Overview

This webinar will be presented by two established ADR professionals: Lisa Romeo, who is the American Arbitration Association's Vice President-Commercial-New England, and Paul Gupta, who serves as an arbitrator and mediator on several AAA panels, and also serves as counsel in ADR proceedings.

Over the past few decades, there has been dramatic growth in the importance of arbitration for all types of commercial disputes. The COVID-19 pandemic further highlighted arbitration's advantages, particularly its flexibility and ability to adapt to virtual settings.  B2B arbitrations recently had a double-digit percentage growth year-over-year. Overall, the AAA has resolved over 300,000 cases in just the first seven months of this year and has administered over 8 million cases since its founding 98 years ago.

It has become essential for all lawyers, as well as businesspeople who are involved with commercial disputes, to understand the importance and benefits of arbitration. Many lawyers and businesspeople are currently or will be involved with arbitrations in the course of their careers. This includes drafting arbitration clauses; serving as primary counsel; or managing arbitration-related business impacts. The webinar caters to all experience levels.

Lisa and Paul will discuss the best practices for conducting arbitrations. They will discuss:

  • Tips for properly drafting an arbitration provision for efficient and cost-effective proceedings.

  • Assessing the advantages of arbitration in terms of tribunal experience, process, cost and time, finality, and confidentiality.

  • The benefits and risks of using AI and other technology to facilitate ADR proceedings.

  • Techniques for conducting virtual arbitrations.

  • The impact of technology on traditional claims.

  • Claims based on new technologies.

Learning Objectives:

  1. Understand why arbitration provisions need to be drafted as carefully as any other important provision in a contract, and how to provide for an efficient and cost-effective proceeding

  2. Break down the benefits that can be obtained from arbitration, and how to utilize them successfully

  3. Recognize that those who are familiar with AI (and other technology) will replace those who do not know when and how proven tools can be deployed
