Overview

For more than 30 years, the win-loss record for tribal interests at the United States Supreme Court was dismal. Since 2018, however, tribal interests have been on a remarkable winning streak. This course will take a close look at several recent Supreme Court cases in which tribal interests have prevailed. The presenter will discuss what factors might explain this recent winning streak and whether it portends the dawn of a new era in the U.S. Supreme Court's Indian Law jurisprudence. Finally, the course will explore what implications these cases might have for future Indian Law cases at the Supreme Court.  

This program will benefit tribal attorneys, practitioners of federal Indian law, and other attorneys who wish to learn more about federal Indian law.

  2. Apply recent U.S. Supreme Court decisions involving tribal interests

  3. Explore what factors might account for these recent decisions
