Overview

Like other areas of law, immigration law has many different specialties and niche areas. One of these areas relates to granting a visa to those who have an extraordinary ability from which the United States and its citizens can benefit. As the 21st century is defined by globalization and information, the O-Visa, or the ‘extraordinary ability visa’, is more important than ever as nations share their creative talents and resources, enriching the lives of citizens worldwide. This is especially true in a country like the United States and the O-Visa makes this possible. Whether entertainers, artists, scientists or chefs, the O-Visa is the bridge that allows the United States to invite others into this country and exchange talent.

Due to the abundance of resources outlining how the O-Visa process works, this course will specifically focus on the nuts and bolts of how the O-Visa is acquired from start to finish in specific industries. The course is designed to demonstrate this through various hypotheticals so that the practitioner is aware of all the strategies available to successfully acquire an O-Visa for his/her client.

  1. Articulate the history and legislative intent (purpose) behind the O-1 Visa as well as the relevant applicable authority
  2. Understand the application requirements and the strategy involving evidence to make an O-1 application a success
  3. Learn, with specific examples or hypotheticals pertaining to specific industries, how an O-1 visa is granted
