Overview

This essential program addresses the growing importance of alternative dispute resolution issues arising from supply chain disruptions in an increasingly interconnected yet uncertain U.S. and global economy. The program is designed for attorneys and related businesspeople and consultants. All businesses, insurers, transportation/logistics companies, and others are facing old and new U.S. and international supply chain issues, and potential or actual disputes. As the Federal Reserve Bank of New York's Global Supply Chain Pressure Index demonstrates, we need to deal with and prepare for mounting pressure on supply chains from tariffs, military conflicts, environmental events, labor shortages, epidemics, and technology failures. Everyone dealing with supply chains needs to understand how ADR is being used and can be used to deal with these growing challenges. The program examines how supply chain failures create cascading disputes not only between direct contractual parties, but also among ancillary contractual participants in employment, investment, lending, and construction relationships. Parties to supply chain disputes typically have contractual relationships, and the contracts generally have ADR provisions.

Led by experienced ADR professionals from major providers and arbitration practices, this program provides practical guidance on maximizing the benefits of arbitration and mediation for supply chain disputes that often involve multiple parties, complex technical evidence, and domestic and international enforcement challenges. Participants will learn proven techniques for conducting virtual ADR proceedings, utilizing technology platforms effectively, and drafting stronger arbitration provisions to address supply chain vulnerabilities. The faculty's combined expertise spans domestic and international arbitration, insurance disputes, logistics operations, and risk management consulting, offering audience members comprehensive strategies for successfully handling supply chain disputes. 

Learning Objectives:

  1. Analyze the unique characteristics of supply chain disputes, and identify how contractual breakdowns, insurance gaps, transportation failures, and regulatory requirements create ADR challenges requiring specialized arbitrator expertise and case management approaches

  2. Evaluate the strategic advantages of arbitration versus litigation for supply chain disputes, including tribunal selection processes, confidentiality requirements, domestic and international enforcement capabilities, and cost-effective resolution of complex technical issues

  3. Develop effective mediation strategies for supply chain conflicts, determine optimal timing for mediation intervention, and structure settlement discussions among multiple stakeholders with competing interests

  4. Implement proven techniques for virtual ADR proceedings, including secure platform utilization, electronic exhibit management, and coordination of neutrals, parties, counsel, and witnesses across multiple U.S. and international jurisdictions and time zones

  5. Draft comprehensive arbitration provisions and supply chain agreements that anticipate disruption scenarios, incorporating AI and other technology considerations, insurance and transportation concerns, and enforcement mechanisms for domestic and international disputes


Chair and speaker: Paul Gupta. He has served as an arbitrator, mediator or lead counsel in over 175 disputes involving technology, financial, employment, and other issues. He is currently active in many ADR matters in several venues. He is a member of the Executive Committee of the NYSBA Dispute Resolution Section and the founding co-chair of its Technology Committee. He is also a member of the AAA-ICDR Financial Services Advisory Committee. He recently chaired programs for Lawline on "Arbitration Best Practices in the Digital Age" and "Arbitration of Financial Services Disputes." He also recently  chaired a program for the American Arbitration Association on "Employee Mobility, Non-competes and Other Employment Agreements." He was appointed by the New York State Chief Judge to serve on the Statewide Advisory Committee on ADR, which coordinates Court and ADR matters. He has been invited to lecture many times at the American Arbitration Association on training programs for case managers and ADR practitioners, in New York, Providence, and San Francisco. He was a speaker on the NYSBA program on Habits of Highly Effective Dispute Resolvers.

 

Speaker: Lisa Romeo. She is Vice President at the American Arbitration Association's Boston Regional Office responsible for recruitment of potential arbitrators, outreach, education and business development for Commercial Disputes in New England. She also manages large, complex commercial arbitrations in Massachusetts and New York.   She is national co-lead for Technology business development for the AAA and also performs outreach and education in the Cannabis, Insurance and Franchise industries. Employed by the AAA since 1988, Lisa has a B.A. from Bates College and a Master of Science in Management from Lesley University focusing on Institutional Development.  

 

Speaker: Toni Gomes. She is the Director of ADR Operations at the American Arbitration Association (AAA), where she has over 13 years of experience managing arbitration and mediation services across domestic and international matters. She also spent 5 years with the AAA's global division, the International Centre for Dispute Resolution (ICDR), handling cross-border disputes and international case administration. Toni began her legal career as a judicial intern with the Rhode Island state courts and is a graduate of Rhode Island College. She is known for her commitment to procedural fairness, operational efficiency, and advancing access to justice in both U.S. and international arbitration contexts.

 

Speaker: Paul Sills. He is an international arbitrator and mediator based in London with over 30 years of experience in dispute resolution across sectors including transport, logistics, construction, and energy. Paul is a member of Arbitra International based in London. Prior to becoming a full-time neutral, Paul held senior executive roles, including as CEO and Director of international freight and logistics businesses, and Managing Director of a global construction company. His legal and commercial expertise gives him unique insight into supply chain disputes involving contractual breakdowns, transport failures, and regulatory disruption. He regularly acts in complex, multi-party arbitrations and mediations, including those arising from cross-border supply chain pressures and systemic risks. Paul teaches International Commercial Arbitration to the LLM Students at Westminster University Law School in London.

 

Speaker: Michael Flaharty. He is a Managing Director within FTI Consulting, Inc.'s Global Insurance Services Practice in New York. FTI is a global consulting company with over 8100 employees in 85 cities. He has over 45 years of insurance claims and risk management experience with arbitrations and other disputes.  He has been called upon as an expert in various insurance and reinsurance arbitrations for a variety of insurance industry clients including AIG, Tokyo Marine, GE Warranty, DARAG, Lloyds Markets, the State of Nevada Department of Insurance and DARAG UK. Additionally, he has served as interim risk and claims officer for various insurance and reinsurance operations, and third-party administrators. He has also handled matters for insureds. Mike was the risk manager for a Fortune 25 corporation which served as a portfolio manager for over 100 global and domestic companies that were involved in a variety of insurance and other disputes which were subject to arbitration. Prior to joining FTI Consulting, he was owner and principal of a New York based consulting practice focused on claim strategy and operational improvement to the insurance industry. He was also a partner at a Big 4 consulting firm where he led multiple insurance practice areas related to claims, liquidation, risk management and insurance supply chain operations.
