Overview

Everyone is doing it. TikTok. Instagram. Facebook. Twitter. Your clients are on social media, and every attorney needs to understand the impact this can have on their case. This program, taught by Lauren Ellerman, a plaintiff's medical malpractice and serious injury attorney, will review best practices in counseling clients on the strategic use and dangers of social media evidence in injury cases, as well as how to use social media evidence to plaintiff's advantage, and/or defend its use against your client at trial. The course will take a practical view of social media evidence to help attorneys use client social media posts ethically and to the client's legal advantage.

The program will focus on personal injury, medical malpractice, worker's compensation or negligence cases, but may benefit attorneys with other litigation practices as well.

Learning Objectives:

  1. Discuss the ethical standards for deleting social media posts once you are in litigation (hint - you can't)
  2. Strategically use social media posts for injured clients
  3. Evaluate your client's social media pre-litigation
