Course Description

Everyone is doing it. TikTok. Instagram. Facebook. Twitter. Your clients are on social media, and every attorney needs to understand the impact this can have on their case. This program, taught by Lauren Ellerman, a plaintiff’s medical malpractice and serious injury attorney, will review best practices in counseling clients on the strategic use and dangers of social media evidence in injury cases, as well as how to use social media evidence to plaintiff’s advantage, and/or defend its use against your client at trial. The course will take a practical view of social media evidence to help attorneys use client social media posts ethically and to the client’s legal advantage.

The program will focus on personal injury, medical malpractice, worker’s compensation or negligence cases, but may benefit attorneys with other litigation practices as well.


Learning Objectives:

  1. Discuss the ethical standards for deleting social media posts once you are in litigation (hint - you can’t)
  2. Strategically use social media posts for injured clients
  3. Evaluate your client’s social media pre-litigation

Lauren Ellerman

Prior to moving to the valley, Ms. Ellerman worked in Leesburg Virginia at Sevila, Saunders, Huddleston & White where she focused her time on commercial litigation, criminal, and domestic law.

Ms. Ellerman now focuses her practice on medical malpractice, nursing home abuse, serious personal injury and business litigation. Ms. Ellerman attended the College of William & Mary, T.C. Williams School of Law, University of Richmond, and the National Trial College.

Ms. Ellerman is a member of the Roanoke Bar Association, the Virginia Womens Attorney Association, the Virginia State Bar , Young Lawyers Conference, Virginia Trial Lawyers Association, American Association of Justice (formerly The Association of Trial Lawyers of America), and the Virginia Bar Association.

When Ms. Ellerman is not representing clients in court throughout Virginia and West Virginia, you can find her working on the Roanoke Dog Park, volunteering at the Rescue Mission or with Second Presbyterian Church.

She also writes a blog for Blue Ridge Outdoors Magazine.

Ms. Ellerman and her husband Whit, a Roanoke attorney, are the proud parents of two dogs and two cats.

Very educational and entertaining. I once used social media to win a wrongful termination case that was almost entirely "he said/she said" about what happened. I strongly agree with the point that you need to look at these early. We ended up having to depose an expert in Spanish translation because there was a dispute about what Spanish comments/posts actually meant in the case.
