Course Description

Time 61 minutes
Difficulty Intermediate

In Illinois, the laws that govern the commercial landlord-tenant relationship is much different than its residential counterpart. This course, presented by real estate attorney Katherine Rehan, will address state law and customary practices that impact commercial leasing, including the enforceability of leases, disclosures, transfer taxes, rents, security deposits, and more.

Commercial landlord-tenant relationships are governed not only by state and federal law, but depending on where the property is located, municipal law may impose additional or different requirements on both the landlord and tenant. This course will address the different rights and responsibilities of both the landlord and tenant who are parties to a commercial lease and recent developments in the law.

Learning Objectives:

  1. Gain an understanding of the commercial landlord-tenant relationship beginning with the execution and enforceability of commercial leases
  2. Analyze the relevant statutes and ordinances that pertain to the Illinois commercial landlord-tenant relationship
  3. Discuss landlord rights and responsibilities, as well as those of the commercial tenant in Illinois, and remedies for any violations that may occur during the tenancy
  4. Review recent case law and statutes that have been enacted regarding commercial leasing and the commercial landlord-tenant relationship
