As with many areas of environmental law, a number of ongoing developments are impacting the reach of the Clean Water Act, including the Environmental Protection Agency's revised definition of "waters of the United States," litigation over discharges into groundwater, and litigation about when jurisdictional determinations may be challenged. This program will cover both historical and recent interpretations and developments, and predictions for the near future.
