Overview

Agreeing to comply with a prospective client's outside counsel guidelines can help a lawyer obtain work in a competitive marketplace. However, outside counsel guidelines - which can cover everything from billing protocols and cybersecurity protection to the scope of the representation - can also create risks for law firms that do not take the time to fully vet the guidelines before agreeing. This presentation, taught by Dentons attorneys Craig Giometti and Alanna Clair, will cover common terms and risks of outside counsel guidelines to help firms capitalize on opportunities and meet expectations. Clair is a co-author of bi-monthly articles on legal ethics in "The Daily Report," the legal treatises "The Lawyer's Handbook: Ethics Compliance and Claim Avoidance," and the 2020 edition of "Georgia Legal Malpractice Law."

Learning Objectives:
  1. Consider clients' expectations for compliance with guidelines and what certifications firms may need to stay competitive
  2. Discuss the marketplace for outside counsel when considering "must-haves" and "must not" in outside counsel guidelines
  3. Maximize ethical protections and business opportunities in negotiating outside counsel guidelines
