Overview

The law involving the rights and interests of the LGBT community in the workplace has been rapidly evolving. Two landmark decisions—Obergefell v. Hodges, 135 S. Ct. 2584 (2015) and U.S. v. Windsor133, S. Ct. 2675 (2013)—both involving issues of equality for same sex individuals—dramatically changed the legal landscape with respect to employee rights and benefits.

In addition, and as a result of these cases, old assumptions about the viability of gender identity claims and sexual orientation claims in federal court and administrative agencies are facing new challenges. This course offers a comprehensive overview of LGBT rights in the workplace, including viable causes of action to challenge workplace discrimination based upon gender identity and sexual orientation and employee benefits.

  1. Understand how the Supreme Court’s marriage equality decisions have affected LGBT rights in the workplace
  2. Review recent developments in employment law and their effects on LGBT protections
  3. Explore strategies to redress workplace mistreatment on the basis of gender identity or sexual orientation
  4. Examine the role of the Equal Employment Opportunity Commission in recognizing gender identity and sexual orientation discrimination
  5. Discuss employment benefits issues for LGBT people
