The law involving the rights and interests of the LGBT community in the workplace has been rapidly evolving. Two landmark decisions—Obergefell v. Hodges, 135 S. Ct. 2584 (2015) and U.S. v. Windsor133, S. Ct. 2675 (2013)—both involving issues of equality for same sex individuals—dramatically changed the legal landscape with respect to employee rights and benefits.

In addition, and as a result of these cases, old assumptions about the viability of gender identity claims and sexual orientation claims in federal court and administrative agencies are facing new challenges. This course offers a comprehensive overview of LGBT rights in the workplace, including viable causes of action to challenge workplace discrimination based upon gender identity and sexual orientation and employee benefits.
