Forum Non Conveniens in Aviation Cases

Aired on

Intermediate

Overview

Join aviation attorney Justin Green for a discussion of the legal background of the forum non conveniens doctrine in aviation cases. The forum non conveniens doctrine allows courts to abstain from exercising jurisdiction over cases if the courts determine that based on private and public factors the cases should proceed in a different court. Unfortunately, the doctrine has led to the dismissals of many aviation disaster cases where the disaster occurred outside the United States.

This program will address the major forum non conveniens decisions in the aviation context. It will conclude with practice pointers for avoiding dismissal, and will address the growing belief that the doctrine is overused and that it has outlived its usefulness.

Learning Objectives:
  1. Examine the forum non conveniens doctrine, and how it is applied in the aviation context
  2. Review the major aviation cases in this field
  3. Gain practice pointers for litigating forum non conveniens claims
