Overview

This course will review key case law from 2020 in the areas of D&O coverage and E&O coverage, including employment practices and fiduciary liability, and how attorneys should incorporate these developments in their practice. Some of the issues and questions to be considered include choice of law provisions, whether insurers should avoid bringing suit in Delaware, the COVID pandemic and rising insolvencies, hacking and cybersecurity threats, and other emerging exposures that may affect the coverage landscape. The program will also provide practical guidance for practitioners in terms of policy wordings.
