When employees and their families lose their health benefits, federal law (COBRA) provides them with the option to continue their health coverage under certain circumstances such as voluntary or involuntary job loss, reduction in work hours, death, divorce, and other life events. In addition to Federal COBRA, Texas law also mandates that employers offer continuing health benefits under state law (“Texas State Continuation”). In this program, employment attorney Alicia Haff and Cobra Specialist Ouida Peterson discuss Texas State Continuation and its recent 2009 amendments. They provide details on the benefits it offers to employees, its eligibility requirements, and the information that must be provided to employees once they lose their insurance benefits. The presenters also discuss the severe repercussions that may occur if employers fail to offer Texas State Continuation to employees (e.g., having to pay for a former employee’s medical costs that would have otherwise been covered by the group insurance policy). They conclude this CLE with a comparison of the differences between Federal COBRA and Texas State Continuation. This is an important program for Texas attorneys as it will help them minimize liability risk for clients and help them create sound policies and procedures.
