Criminal defense attorneys and prosecutors need to make sure that they keep abreast of the latest judicial decisions concerning the Fourth Amendment. In this program, the Honorable Barry Kamins, Administrative Judge for Criminal Matters in the Second Judicial District, reviews New York’s most recent cases concerning search and seizure law. Judge Kamins provides an in-depth analysis of the situations where law enforcement conduct can trigger the exclusionary rule as well as when the attenuation exception applies. Judge Kamins also examines when the “All Persons Present Warrant” is merited and the scope of authority it affords to police officers when searching a premises. In addition, he explains how evidence obtained during warrantless searches is admissible in exigent circumstances – even where the police officers caused the exigent circumstance. The final part of Judge Kamin’s presentation covers the extent of how “canine sniffs” can be used during Vehicle and Traffic Law stops. Don’t miss this rare opportunity to learn about the most updated rulings on New York’s criminal search and seizure law from a judge who is involved in effectuating these changes on a daily basis.
