About this Program

Can personal trainers and gyms be liable for injuries sustained by individuals during personal training sessions? Join personal injury attorney Andrew J. Smiley as he explains how trainers can be responsible for their clients' injuries and all the steps plaintiffs must take to win these lawsuits.  Mr. Smiley discusses which negligent actions are available and the necessary questions attorneys must ask their clients to determine the viability of a case.  In addition, by sharing the fact pattern and litigation strategies from an actual case, Mr. Smiley demonstrates how an attorney can discover if a trainer has the proper certifications, what is required in a program design, and the significance of experts in the discovery and trial phases.  Finally, viewers will learn how to prepare plaintiffs for depositions, and what key questions must be posed to the trainers and their supervisors.  This course will be useful for all personal injury attorneys as well as any individual who works out at a fitness gym and wants to understand his/her rights.

The attorney speaker is a NY attorney, and part of his presentation was based upon the laws of NY state as they pertain to assumption of risk and enforceability of written waivers of liability. Still, the course was very worthwhile and applied to Florida except as to those points mentioned above.
