In this highly innovative approach to CLE lecturing, experienced mediator Margaret Shaw and legal professionals from the law firm of Seyfarth Shaw utilize role-playing to engage in a mock mediation. The fictional case pits a successful corporation against an employee who alleges sexual discrimination in her failure to get a promotion, with the corporation, in turn, citing gross misconduct on the part of the employee as the reason behind that failure. On top of this already volatile setup, the mediation is complicated by the development of ethically questionable behavior on the part of both lawyers, with the plaintiff’s attorney opting to make use of inadvertently disclosed evidence, and the defense attorney confronted with the reality that her client has engaged in fraudulent activities. Legal Professionals from Seyfarth Shaw play the respective roles of lawyers and clients, and Partner William Perkins rounds out the dynamic troupe, moderating the discussion and intermittently pausing the mediation to focus attention on the myriad issues raised. General practice tips are also provided in the course of the discussion, adding hands-on applicability to this vastly informative program.
