Commercial leasing has evolved into a highly complex area of law, especially taking into consideration the interplay of numerous (sometimes seemingly unrelated) clauses. The savvy leasing lawyer must therefore bring a laser-like focus on "silent” issues lurking beneath the language of a lease that can cause substantial hardship to an unwary tenant. Join attorney Jeffrey Margolis in this program that covers some advanced commercial leasing issues. Mr. Margolis begins his presentation with an explanation of “good guy guarantees” and what can be done to limit a guarantor’s liability when a landlord decides to hold the guarantor responsible for a tenant’s default. He then provides guidance as to what tenants can do to protect themselves in these turbulent economic times when landlords are frequently at risk of filing bankruptcy or foreclosure. He also mentions specific language that can be incorporated into leases that enable tenants to assign or sublet their lease as easy as possible. Mr. Margolis concludes his presentation with a discussion of the “option to renew” clause and the importance of establishing clear guidelines. This program will be valuable for attorneys seeking to gain in-depth knowledge of commercial leases.
