Advanced Immigration Waiver Practice: A Legal Practicum For Surmounting Extreme Hardship & Waiving Inadmissibility
About this Program
With the January 3, 2013 announcement of the I-601A Provisional Waiver available this March, the standard of “extreme hardship” has come to the forefront of immigration practice. It is now more important than ever to understand and analyze this historically stringent standard in the context of waivers. “New Jersey Immigration Lawyer of the Year 2012” Harlan York will examine the standard as it has evolved out of the decisions of the Administrative Appeals Office as well as the decisions of the Board of Immigration Appeals. He will discuss how the standard has been applied in I-601 Waivers of Inadmissibility and ways to beat the odds, going beyond the “common”effects of deportation of a loved one. Mr. York will also provide a comprehensive review of the Federal Register as it has established the procedures and particulars of the Provisional Waiver. He will also cover a host of other immigration waivers.
I. Learn the kinds of waivers available in immigration law
II. Understand the I-601 Waiver of Inadmissibility and the Extreme Hardship standard.
III. Explore the AAO and BIA application of the Extreme Hardship standard.
IV. Analyze how to establish Extreme Hardship in circumstances classically not “extreme.”
V. Comprehend the procedure and codification of the I-601A Provisional Waiver.
VI. Determine eligibility and disqualifying criteria for the I-601A Provisional Waiver as defined by the Federal Register
VII. Explore the I-212 Waiver of Deportation.
VIII. Review the INA §237(a)(1)(H) Discretionary Waiver for Certain Misrepresentations.
IV. Study the proper engagement of the §212(d)(3)(A) Waiver for Nonimmigrant Visas.

One of the best seminars I've taken. Great content.
Mr. York did an exceptional job with this presentation. It was very informative. He packs so much good information into this one hour. I plan to watch the replay when it is available. For now, I will look for other presentations by him.
