Defamation Law: Past to Present

Faculty: George Freeman
Production Date: January 13 2010

Description

The United States places a high premium on freedom of speech, but limitations still exist. George Freeman, Vice President and Assistant General Counsel of The New York Times Company, brings a unique perspective to the limitations of libel law through a discussion of his experiences with working with the news media and significant case law. The definition of libel is explained, along with the specific exceptions to this definition. The uniquely American fault standard, and how this standard is applied to different categories of people, is also examined in detail. Freeman also includes common law defenses, such as the truth and opinion approach, and offers guidance on how to avoid the common causes of libel cases.

Agenda:
I.      Definition of Defamation
II.     New York Times Co. v. Sullivan and Actual Malice
III.    The Fault Standard Defense
IV.    Common Law Defenses
V.     Common Causes for Libel
