Andrew Singer and Stacey Usiak provide attorneys with everything they need to know about wage and hourly employment law in New York State and its intricate relationship with independent contractors. Topics include the requirements for record-keeping, commission agreements, wage deductions, the salary basis test for overtime work, the definition of independent contractors, and the various risks of misclassification.

Andrew W. Singer has extensive experience in all aspects of employment law and provides our clients with a full spectrum of legal services, from every day counseling to complex employment litigation.
Andrew regularly counsels employers on issues such as sexual harassment, discrimination, accommodating disabled employees, family and medical leave laws, hiring, disciplining and terminating employees, classifying employees and independent contractors, e-mail and internet policies, non-competition and confidentiality agreements, internal corporate investigations and drafting and negotiating employment and separation agreements.
Andrew has extensive experience in defending discrimination claims based upon sex, race, sexual orientation, national origin, religion, disability, age and other protected classes. He has also handled discrimination matters filed with the Equal Employment Opportunity Commission and the State Division of Human Rights.
Andrew also conducts training seminars for supervisory and managerial employees on equal employment laws and sexual harassment and is frequently asked to speak on such matters at corporate sponsored programs and seminars.
Stacey Usiak counsels employers in all aspects of employment law and employee relations including selecting, training, managing and terminating employees; complying with wage and hour laws; preventing, investigating and responding to discrimination and harassment complaints; accommodating applicants and employees with disabilities; administering family and medical leave plans; conducting background checks, substance abuse testing and workplace investigations; and resolving workplace disputes. She advises clients on handling day to day personnel issues in compliance with federal, state and local employment and labor laws, including, Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the Fair Credit Reporting Act, COBRA and the Fair Labor Standards Act. She regularly reviews and drafts employee handbooks, employee policies and procedures, employment agreements, executive compensation agreements, commission agreements, separation agreements and releases, and non-competition, non-solicitation and confidentiality agreements.
Stacey has also negotiated and drafted documentation in connection with a broad range of general corporate matters for privately held companies, including stock purchases, asset purchases, operating agreements, shareholder agreements, partnership agreements, contractor and subcontractor arrangements and distribution agreements.
